Cannot send "unable to accept" message to Szeligi dispatcher

When playing dispatcher at Strzalki, (sometimes?) when responding to Szeligi's question whether track 2 is clear for a train, no response is sent when I select unable to accept train x on track y, I get an assist notification instead which forces me to accept the train even when I do not want to.
